Overview

The 'good character' requirement is one of the most important — and most misunderstood — requirements for Australian citizenship. If you have a criminal record, pending charges, or other character concerns, your citizenship application may be refused or delayed. I provide specialist advice on how character issues affect citizenship eligibility and how to present your case in the strongest possible light.

Verify all deadlines independentlyThe character issues & citizenship deadlines and time limits referenced on this page are general guidance only and may not reflect your specific circumstances. Appeal periods and response deadlines vary depending on the visa type, the basis of the decision, and how and when the decision was notified to you. Always check your decision letter for the exact deadline that applies to your case and seek independent legal advice before relying on any date. Getting a deadline wrong can permanently affect your appeal rights.

The Department of Home Affairs assesses character for citizenship purposes by considering criminal convictions, pending charges, involvement in people smuggling, association with criminal organisations, and any conduct that is not consistent with the values of Australian citizenship. A criminal record does not automatically disqualify you — the Department considers the nature and seriousness of the offence, how long ago it occurred, and evidence of rehabilitation.

I have extensive experience in citizenship applications involving character issues, including serious criminal convictions, spent convictions, juvenile offences, and overseas criminal records. I prepare detailed character submissions that address the Department's concerns and present compelling evidence of rehabilitation and good character.

Common questions about

Can I get citizenship if I have a criminal record?+
A criminal record does not automatically disqualify you from Australian citizenship. The Department considers the nature and seriousness of the offence, how long ago it occurred, and evidence of rehabilitation. Minor offences and spent convictions are generally less of a concern than serious or recent offences. I can assess your specific situation and advise on the best approach.
Do I need to disclose overseas criminal records?+
Yes. The citizenship application requires you to disclose all criminal convictions, including overseas convictions. Failure to disclose can result in refusal on the grounds of providing false or misleading information, which is a serious matter that can also affect future visa and citizenship applications.
